Il Forum per cambiare l’ordine delle cose aderisce con convinzione alla lettera aperta, già sottoscritta da 85 ong, rivolta al governo greco e alle istituzioni europee per chiedere di fermare quanto sta succedendo in Grecia, dove centinaia di persone che provano a raggiungere l’Europa vengono bloccate al confine in modo violento, in totale violazione dei diritti umani. Chiediamo con forza che venga fermato il clima di intolleranza e razzismo che si è scatenato contro le persone migranti e contro le ong. Sollecitiamo un’assunzione di responsabilità europea, a garanzia dello stato di diritto.

Lettera aperta di 85 organizzazioni

Atene, 6 marzo 2020 – Le organizzazioni sottoscritte sono profondamente preoccupate per i recenti sviluppi al confine di Evros e delle isole dell’Egeo, dove le persone sono bloccate ai confini dell’Europa, strumentalizzate per scopi politici e soggette a violazioni dei loro diritti.
Siamo anche profondamente preoccupati per il modo in cui le autorità della Grecia e dell’Unione Europea stanno gestendo i nuovi arrivi.
Altrettanto allarmanti sono le azioni estreme delle forze di sicurezza contro i rifugiati e dei civili contro il personale delle organizzazioni umanitarie e per i diritti umani.
Vorremmo anche sottolineare che il clima di panico e la retorica della “minaccia asimmetrica” – anch’essa promossa dalle autorità – non riflette la realtà e colpisce seriamente non solo i rifugiati vulnerabili, ma anche la nostra società e lo Stato di diritto nel suo complesso.
In particolare:
Esprimiamo la nostra ferma opposizione alle recenti decisioni del Consiglio Governativo Greco per gli Affari Esteri e la Difesa (KYSEA), e in particolare all’adozione del Decreto Legislativo d’Emergenza, che prevede la sospensione del diritto di chiedere asilo per tutte le persone che entrano nel Paese e il loro ritorno senza registrazione, nei loro Paesi di origine o di transito. L’applicazione di tale disposizione normativa è disumana e illegale in quanto viola il principio fondamentale di non respingimento, comporta responsabilità internazionali per la Grecia e mette in pericolo vite umane. È fuori discussione che la Grecia abbia la competenza sovrana di controllare i suoi confini e di gestire i suoi eventuali attraversamenti. Tuttavia, il diritto di chiedere asilo è un diritto umano fondamentale sancito dalla Dichiarazione universale dei diritti dell’uomo e dalla Carta dei diritti fondamentali dell’UE.
Denunciamo anche gli attacchi alle organizzazioni che difendono i diritti umani e alle organizzazioni umanitarie, rilevando che senza il sostegno di queste organizzazioni, il sistema di gestione dei rifugiati in Grecia crollerebbe. Inoltre, la solidarietà è stata stigmatizzata ed è diventata oggetto di sospetti, clima che è stato esacerbato dai membri del governo, fomentando la violenza e l’illegalità nella società in generale. Denunciamo qualsiasi dichiarazione, azione o politica che fomenti o tolleri fanatismo e razzismo.
Chiediamo al governo greco di:
– Ritirare il decreto legislativo d’emergenza illegale e incostituzionale e rispettare gli obblighi in materia di protezione della vita umana e di salvataggio in mare e alle frontiere terrestri
– Smettere immediatamente di rimandare le persone in Stati dove la loro vita e la loro libertà sono a rischio, o dove rischiano di essere sottoposte a tortura o ad altri trattamenti inumani o degradanti.
– Ridurre immediatamente il sovraffollamento delle isole trasferendo i richiedenti asilo sulla terraferma, proteggendo il loro benessere e la loro salute. La priorità dovrebbe essere data ai minori non accompagnati, più vulnerabili, e alle famiglie con bambini.
– Adottare le misure necessarie per proteggere ogni persona da atti di violenza e razzismo.
Ricordiamo che l’UE dovrebbe assumersi responsabilità sostanziali per la protezione delle persone in movimento in modo da dimostrare rispetto per la dignità umana e la legalità, oltre che responsabilità condivisa tra gli Stati membri nel contesto della gestione di quella che è, prima di tutto, una questione europea.
Il diritto d’asilo e il rispetto del principio di non respingimento sono elementi fondamentali del diritto internazionale e dell’UE e pertanto le autorità dell’Unione europea devono adottare le misure necessarie per la loro protezione.
Pertanto:
– La Commissione europea, in quanto custode dei trattati, dovrebbe proteggere il diritto d’asilo come sancito dal diritto dell’UE. Quindi dovrebbe invertire la retorica “dello scudo” usata dalla Grecia, sollecitandola piuttosto ad assumersi i suoi obblighi legali.
– Gli Stati membri dell’UE dovrebbero ripristinare immediatamente i meccanismi per il trasferimento dei rifugiati e dei richiedenti asilo dalla Grecia ad altri Stati membri, in modo equo e razionale, dando priorità ai minori non accompagnati. Gli Stati membri dell’UE dovrebbero aumentare il reinsediamento dei rifugiati direttamente dalla Turchia.
– Gli Stati membri dell’UE e le istituzioni dovrebbero rivedere la dichiarazione UE-Turchia, che, oltre a creare lacune giuridiche, si è dimostrata uno strumento politico imprevedibile e insostenibile per la gestione delle frontiere.
In conclusione, invitiamo tutte le parti a rispettare la legge e a salvaguardare i valori democratici europei.
Ogni ulteriore regresso avrà conseguenze importanti sulle società europee, sulla democrazia europea e sullo stato di diritto.

Open Letter by 85 Organizations

Athens, 6 March 2020 – The undersigned organisations are deeply concerned about recent developments at the Evros border and the Aegean islands where people are stranded at the borders of Europe, instrumentalized for political purposes, and subject to violations of their rights. We are also deeply concerned about the way the authorities of Greece and the European Union are handling new arrivals. Equally alarming are the extreme actions by security forces against refugees and by civilians against staff of human rights and humanitarian organizations. We would also like to point out that the climate of panic and rhetoric of ‘asymmetric threat’ –also promoted by the authorities– does not reflect reality and seriously affects not only vulnerable refugees- but also our society and the rule of law as a whole.
Specifically:
We firmly express our opposition to the recent decisions of the Greek Governmental Council on Foreign Affairs and Defense (KYSEA), and in particular the adoption of the Emergency Legislative Decree, which stipulates the suspension of the right to seek asylum for all people entering the country and their return without registration, to their countries of origin or transit. Applying such a regulatory provision is inhumane and illegal as it violates the fundamental principle of non-refoulement, incurs international responsibilities for Greece and endangers human lives. It is beyond dispute that Greece has the sovereign competence to control its borders and to manage any crossings there. Nevertheless, the right to seek asylum is a fundamental human right enshrined in the Universal Declaration of Human Rights and the EU Charter of Fundamental Rights.
We also denounce the attacks on organizations that defend human rights and humanitarian organizations, noting that without the support of these organizations, the refugee management system in Greece would collapse. In addition, solidarity has been stigmatized and become the target of suspicion, which has been also exacerbated by members of the Government, fomenting violence and lawlessness in society in general. We denounce any statements, actions or policies that foment or tolerate bigotry.
We call upon the Greek Government to:
• Withdraw the illegal and unconstitutional Emergency Legislative Decree and to respect the obligations of the Greek State concerning the protection of human life and rescue at sea and at the land borders.
• Immediately stop returning people to states where their lives and freedom are at risk, or where they are at risk of being subjected to torture or other inhuman or degrading treatment or punishment.
• Immediately alleviate overcrowding on the islands by relocating asylum seekers to the mainland, protecting their well-being and health. Priority should be given to the most vulnerable, unaccompanied minors and families with children.
• Take the necessary measures to protect every person from acts of violence, victimization and racism.
We recall that the EU should assume substantial responsibilities for the protection of people on the move in a manner that demonstrates respect for human dignity and lawfulness and as a matter of shared responsibility among EU member states in the context of managing what is, first and foremost, a European issue. The right to asylum and the respect for the principle of non-refoulement are fundamental elements of international and EU law and therefore the authorities of the European Union must take the necessary measures for their protection.
Therefore:
• The European Commission, as the guardian of the Treaties, should protect the right to asylum as enshrined in EU law. Therefore, it should reverse the “aspida (shield)” rhetoric used by Greece and urge it to assume its legal obligations.
• EU Member States should re-establish immediately the mechanisms for the relocation of refugees and asylum seekers from Greece to other Member States, in a fair and rational manner, with priority given to unaccompanied children. EU Member States should increase resettlement of refugees directly from Turkey.
• EU Member States and institutions should revise the EU-Turkey Statement, which –in addition to legal lacunae– has now proven to be an unpredictable and unsustainable political tool for border management.
In closing, we call on all sides to respect the law and safeguard European democratic values. Any further backsliding will have major consequences on European societies, European democracy and the rule of law.
