In questi giorni abbiamo ricevuto le richieste di diversi studenti e studentesse relativamente al requisito che l’ambasciata ha inserito nel vademecum in riferimento alla posizione economica della famiglia.
Come spiegheremo nelle osservazioni allegate questo requisito è da considerarsi illegittimo e non conforme a quanto dispone la legge.
Abbiamo deciso quindi di condividerlo anche con voi per farvi conoscere i vostri diritti nella procedura di richiesta del visto per motivi di studio e vi invitiamo a segnalarci i vostri casi per ricevere consigli e supporto. È nostra intenzione inviare questo commento giuridico anche all’ambasciata e al governo italiano per chiedere che venga rimosso questo requisito dalle indicazioni del consolato italiano.
In the last days we have received inquiries from several students regarding the requirements that the embassy has included in the vademecum referring to the economic position of the students’ family in order to apply study visa.
As we will explain in the attached comments this requirement is to be considered illegitimate and not in accordance with the law. Therefore, we have decided to share it with you in order to let you know your rights in the study visa application process, and we invite you to share your cases for advices and to receive support.
It is our intention to send this legal position to the Italian embassy and government in order to remove these requirements from the Italian consulate guidance.
تلقينا في الأيام الأخيرة استفسارات من العديد من الطلاب بخصوص الشرط الذي أدرجته السفارة في في هذا الرابط المرفق فيما يخص الملف الاقتصادي للأسرة. وكما سنوضح في التعليقات المرفقة فإن هذا الشرط يعتبر غير شرعي ولا يتوافق مع أحكام القانون والدستور. لذلك قررنا مشاركتها معكم أيضًا لنعلمكم بحقوقكم كطلاب. ونعتزم أيضًا إرسال هذه الملاحظات القانونية إلى السفارة والحكومة الإيطالية لحثّهم على إزالة أو تعديل هذه الشروط.
فيما يتعلق بالبديل عن مبلغ ال ٦٥٠٠ يورو المطلوب وضعها في حساب الطالب في أحد البنوك في لبنان أو سوريا، أعلنت السفارة أنه بإمكانك الحصول على كفالة شخص إيطالي أو أي شخص مقيم في إيطاليا(ليس طالباً) مع كشف حساب بنكي لآخر ثلاثة أشهر! وملاحظتنا على هذا البند هو لماذا يشترط وجود الكفيل في إيطاليا وليس في الاتحاد الأوروبي أسوةً بباقي الدول؟
وفي بندٍ آخر تطلب السفارة كفالة من الأهل مع كشوفات بنكية للوالدين أو كفالة الشخص الإيطالي، وبيان بالراتب للوالدين (جميعهم يجب توافرهم) وهذا يتنافى مع المادة ١٥ من المرسوم الوزاري رقم ١٠٠ لسنة ٢٠٠٩ والتي تنص على أن مبلغ ٦٥٠٠ يورو تشكل ضمانة كافية للعيش في إيطاليا.
